Short answer: Yes, you can buy land directly from the owner in Texas. The seller drafts the purchase agreement, and the sale closes either in-house with the seller or through a title company. At Victory Land Sales, you buy straight from us: your deed is recorded with the county at closing, Victory holds the lien until the land is paid off, and owner financing comes with simple approval and no minimum credit score.

Plenty of Texas land buyers would rather skip the listing agent and the bank and deal with the person who actually owns the dirt. That can be a faster, simpler way to buy, as long as you know what you're getting and what to check. This guide explains what "for sale by owner" really means for land, how buying direct from Victory works step by step, why the type of deed matters, and the checklist to run on any owner-seller before you sign.

What "for sale by owner" means for land

"For sale by owner" simply means the person or company that holds title is selling the property itself instead of hiring a listing agent. With houses, that's usually one homeowner selling one home. With rural land, it often looks different, because a lot of acreage in Texas is sold by companies that buy a larger property, survey it into smaller tracts and sell those tracts directly to buyers.

Developer-sellers vs individual owners

Both can be good ways to buy, but they work differently:

  • Individual owners are selling a single piece of land, often one they inherited or held for years. Prices and paperwork vary a lot, and some owners have never sold land before. You may need to arrange the survey, title work and closing yourself.
  • Developer-sellers like Victory Land Sales sell many tracts, so the process is set up ahead of time. Tracts are already surveyed into lots, road frontage and utility providers are listed on each property page, the purchase agreement is a standard document, and there's a team that handles closing.

Either way, you're still buying from the owner. The difference is how much of the groundwork you'll have to do yourself.

How buying direct from Victory works

Victory Land Sales owns the land it sells and offers owner financing on its tracts, so there's no bank in the middle and no listing agent between you and the seller. The steps are the same ones listed on our FAQ page:

1. Pick a tract

Start on the properties page or one of the area pages for Lubbock, Amarillo, Corpus Christi or the Rio Grande Valley. Each property page shows the tract sizes, listing prices, road, utility providers and deed restrictions. You're welcome to visit the land any time before you buy; we'll send directions and property details so you can see it for yourself.

2. Apply with simple approval

If you're paying over time, you'll apply for owner financing. Approval is simple: we check credit and verify income, but there's no minimum credit score. If you're paying cash (which can include a bank loan, private funding or your own money), you can skip this step.

3. Review and sign the purchase agreement

We draft the purchase agreement for your review. Once you approve it, we send it for electronic signature, so you don't have to drive to an office to sign.

4. Close, with your deed recorded

Our in-house team handles closing and records your deed with the county. If you're buying directly through us and not using a title company, we can usually prepare the closing package within 24 to 48 hours. With owner financing, you get access to your land right away.

5. Victory holds the lien until it's paid off

Because the deed is in your name from closing, Victory's security is a lien on the land, not the title itself. When the land is paid off, the lien is released and you own it free and clear. You can pay it off early any time, with no prepayment penalty.

Deed at closing vs contract for deed

When you buy from an owner who is also financing the sale, the most important question to ask is when do I get the deed? There are two common setups in Texas:

  • Deed at closing with a lien. The seller signs a deed to you at closing, it's recorded with the county clerk, and the seller keeps a lien as security until you pay off the land. You're the owner of record from day one. This is how Victory sells.
  • Contract for deed. The seller keeps legal title and promises to deliver a deed later, usually after your final payment. Texas law calls this an executory contract, and Texas Property Code Chapter 5, Subchapter D adds buyer protections when the land is used as the buyer's residence.

Why it matters for ownership

With a deed at closing, the public record shows you as the owner, so you're the one building equity in land titled in your name. With a contract for deed, you can make payments for years while the county records still show the seller as the owner. If the seller borrows against the land, runs into legal trouble or never delivers the deed, sorting it out can be slow and costly. Our full comparison, warranty deed vs contract for deed in Texas, walks through the differences in detail.

What to verify with any owner-seller

Buying direct doesn't mean skipping your homework. Whether you're buying from Victory or from a neighbor down the road, check these before you sign:

Recorded deed restrictions

Ask for the deed restrictions in writing, and check whether anything is recorded with the county. Restrictions decide whether you can place a mobile home, live in an RV, keep livestock or run a business. On Victory properties, the most common restrictions are no commercial shooting ranges and no junk yards, and we provide the restrictions for each property. Our guide to unrestricted vs restricted land in Texas covers what to look for.

Survey and boundaries

Make sure the tract has been surveyed and that you know its exact acreage and dimensions. Victory's property pages list each tract's size and frontage, and the plat shows how the lots are laid out. With an individual seller, ask whether a current survey exists or whether you'll need to order one.

Legal access

Confirm the land fronts a public road or has a recorded easement. Land without legal access can be hard to build on, hard to finance later and hard to resell. Note whether the road is paved, caliche or dirt, since that affects driving in wet weather.

Clear title

Ask whether there are liens, unpaid property taxes or other claims against the land. A title search shows what's recorded against the property, and many buyers also choose an owner's title insurance policy from a title company for added peace of mind.

Water and power

Find out how you'll get water (a water line or a well) and power, and which provider serves the land. Ask about septic too: some tracts have a sewer line or septic in place, while raw land usually needs a septic system installed. Our guide to well and septic on raw land in Texas explains what to expect, and each Victory property page names the electric provider for that subdivision.

Property taxes and exemptions

Check the county appraisal district for the current tax value and whether the land has an agricultural valuation. If you plan to run animals or farm, read ag exemption on 10 acres in Texas before you buy.

Title company or in-house closing?

When you buy directly from an owner, you can close in-house with the seller or through a title company. An in-house closing is typically faster: at Victory, the closing package can usually be ready within 24 to 48 hours when you're not using a title company, and our team records the deed with the county for you.

A title company adds a neutral third party that searches the records, handles the documents and can issue title insurance, which some buyers prefer, especially on larger purchases. If you'd like a title company you trust to handle your closing, just tell us up front so we can plan the timeline together.

Questions to ask any owner-seller

  • Will my deed be recorded in my name at closing?
  • Who holds the lien, and how is it released when I pay off the land?
  • Can I see the deed restrictions and the survey or plat?
  • Does the land have legal road access, and who provides power and water?
  • Can I visit the land before I sign?
  • Can I pay it off early without a penalty?

A seller who answers all of these clearly and in writing is a seller worth working with.

Frequently asked questions

Can I buy land directly from the owner in Texas?

Yes. The owner can sell land without a listing agent, draft the purchase agreement and close either in-house or through a title company. Victory Land Sales sells its own land directly to buyers and offers owner financing.

Do I get the deed when I buy owner-financed land from Victory?

Yes. Your deed is recorded with the county in your name at closing, and Victory holds the lien until the land is paid off. Once it is paid off, the lien is released and you own the land free and clear.

Do you check credit for owner financing?

Yes. Victory checks credit and verifies income, but approval is simple and there is no minimum credit score.

How long does closing take?

When you buy directly from Victory and do not use a title company, the closing package can usually be prepared within 24 to 48 hours. Using a title company can add time.

Is buying land from the owner safe?

It can be, if you verify the basics: get the deed recorded in your name, review the deed restrictions, confirm the survey, legal road access and clear title, and know how water and power will reach the land. Ask any owner-seller these questions in writing before you sign.
